An individual might have had an H1B filed by an employer, but for one reason or another, never entered the U.S. or worked for the employer. One might have been in the U.S. as an H1B employee at some point, but then left the U.S. to live abroad. People such as these ask about getting their H1Bs transferred from companies where they either never worked or are no longer working. Since there is no transfer, there is no concern about this issue. If one is abroad, the new company must file a new H1B petition. There is no pay stub problem in connection with the petition for a person living abroad, since there is no possibility of an extension of H1B status when the individual is not in the United States. (Lack of proper pay records may be an issue at the consulate in connection with an H1B visa application for one who was in the U.S. as an H1B employee, but was not being paid the required prevailing wage.) The H1B employee would need a new visa, if the earlier H1B visa stamp had expired.

    0. Keep docs ready for MTR and once you receive the response from INS you should able to reply immed.

    Without denial notice, I am not sure what kind of documents are required for MTR response. This I-140 was denied even without any RFE. There is no clue to guess the reason for denial.

    Hi!!

    I am preparing grren card aplication with EB2-NIW.

    I have question about I485, Part2, Application type.

    If my I140 is pending, which type do I (principal applicatn) and my wife (spouse) have to check?

    Some people said that I can check "a" and my wife can check "b".

    Other people said that I can check "h" with "EB2 NIW" and my wife can also check "h" with "filing concurren
    tly with applicant's spouse I-485".

    Could you let me know which is right?

    My PERM was filed and I got the following email from my lawyers

    " Labor Certification by ABC ABC, Inc. on your behalf has been submitted via the Department of Labor�s (DOL) Permanent Online System as of the above date (April 1) . The application will be adjudicated by a National PERM Processing Center. As the DOL does not currently have a processing schedule for PERM applications, we are unable to predict how long processing will take. In the past, PERM applications have been adjudicated anywhere from a few weeks to several months. Unfortunately, there is currently no way for beneficiaries to check the status of the application. We will contact you as soon as we hear anything specific regarding your case. "

    1. Is there any place where you can check the status ? Since I do not have any reference number, and from the text of the email, I doubt that.

    2. I checked some forums and found that the average processing time is 60 days. Which processing center should I be looking for ? (I work at Oracle in SFO)

    1. Your company or attorney can check the status on http://www.plc.doleta.gov/splash.cfm?CFID=2535523&CFTOKEN=89747015. They must have already got the case# for your application.

    2. The forums are correct. As of today the processing time is approx 60 days.

    Not a big deal in my opinion - the visa system needed a rehaul in any case. Cant undertsand how a tourist visa can double up as a business one.

    Hi all,

    I do have a worry about I140 processing and I hope somebody can help me.
    I finally got my LC approved and now in the concurrent I140 and I485 filling process.
    However, I noticed that there is a minor mistake in filling on my ETA9089.

    My OPT expired on August 14th, 2006 and my H1-B was approved Dec 12th2006. However in the job experience part, there is a booboo. Instead of putting the start date as January 15th, 2007 (which was the date I started working in the company), they put August 14th, 2006. So from USCIS standing point of view, it could mean that I work during the gap between my OPT and H1-B! :(
    Now I am worried sick that they will deny my I-140.

    Any inputs anybody?

    I was in a similar situation, I took my wife's GC with me when I went to India and she travelled back on GC instead of AP, no issues at the Immigration's.

    "AOS applicant". So she is NOT out of status.

    Is she has to file H4 as my friend's dependent?
    Not necessary.

    Ask both of them to have their EAD ready, if they don't have them yet.

    One of friends 485(primary) was pending and his wife's 485(derivative) also pending.
    Both of them are on H1(different employers) and they both lay-off around the same time about 4 months ago. My friends employer has been running paychecks for him but his wife's employer canceled her H1.

    Is she now on "AOS" status or out-of-status?
    Is she has to file H4 as my friend's dependent?

    I don't think walking in with 485 receipt will work. Call USCIS 800 number and check the status of FP notice, if required open a service request. I'm a july 2 filer, did not receive notice till 10/10 - I called on 10/12 the CSR told me that my FP notice is schedule to be printed and waiting for an appointment with local ASC. In a week time, I received a FP notice, and gonna for FP end of this month. Hope this helps

    Thanks for the info. I have not got FP notice and it has been over 4 months from I-485 receipt date. Do you think ASC will entertain FP request if I just walk in with I-485 receipt?

    If you are a pharmacist then try to speak to big chains like walmart, Rite aid and walgreens. They do H1s for foreign graduates but certain conditions apply like you should have already passed the FPGEE.

    Hi,

    I recently went through same situation for my spouse on H4. You have 3 options:

    1. Call the CBP office where you got I-94 or local CBP office (You can find in Internet, mostly in International Airports) and request them to update thhe I -94. Which may or may not be possible technically. But you may try calling them and schedule an appointment and try this option.

    2. Go out of country and come back.

    3. File a I539 form to extend non immigrant status. Your employer should help you file it or you may file yourself. It should go to same USCIS service center or office which approved your H1 or H4.


    Disclaimer: I am not a attorney. This comment is based on my experience. Please consult and attorney for any legal advise.

    For H1b you cannot file I 539 but need to file I 129 which will cost lot more. I guess going out of country and coming back is good option. if you live near border area.

    You mean photocopy right? If you have scanned copy then print it and send it to USCIS. I don't think they require it in original.

    You are not the primary, right? Your job has nothing to do with the GC case. So you can do whatever regarding your job.
    whether one can take a employer sanctioned long leave of absence for a genuine reason in this case( child care).

    Hello all,
    If my GC is approved, is my employer bound by obligation he gave to USCIS when he filed I140 petition?
    I mean, in I140 employer explicitly stated my future wage, it is 20% higher then wage I am getting from him while I am on H1B.
    Say, my GC is approved and employer refuses to raise my wage to match the amount given in I140. Is there any way to make him stick to this obligation? Like, complaining to DOL, or where else? And if I complain, can it affect validity of my GC?
    The problem is after GC I have to stay with this employer for another 6 months to avoid possible complications in future applying for citizenship. If I just quit and take another job - that will make a possible problem in the future; but if he lays me off, then I am fine. But he does not want to lay me off, and does not want to keep his promise. Any ideas?
