I know for a fact that you cannot count current employer exp for GC.
You can use experience with the same employer, but not in the same position as you note next.
If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??
Nobody could tell just by looking at the DOT job descriptions. Your actual job and duties are what is important, not any DOL codes or descriptions. if your duties in the 2 jobs are 50% different, you should be able to use the experience.

I e-filed yesterday and the address came as USCIS Nebraska Service Center, as expected. My 485 is pending there and my previous EAD was also from NSC.
Where was your last EAD and 485 applied and processed at?

Has any one else experienced this? From the two posters above (which includes me) EAD and AP efiled applications went to National Benefits Center and generated the receipt numbers starting with MSC?
Please share your experience. Is there any thing to worry in this case?

Thanks for your time...please help.
My I-140 Denied couple of months back and I Appealed (I-290B) this decission with all the evidences to prove my exp & employer's ability to pay.
On June 11, 2009 I got the email from USCIS saying my I140 was approved On June 11, 2009.
But, on June 10, 2009 (previous day) USCIS denied my I485 as well as my wife�s I485. Please let me know, how to reopen both of these�

I played around with this a bit, and found the solution. The problem occurred when I had "Empty Project." I created a new project "Console Application," and then I was able to "load" the Process class/namespace. Can anyone explain to me why this would happen? I did a few searches online, but didn't find much help...

I think it can be. When starting the employment based GC process, one of the question asked was ... has any family member ever applied for your immigration petition in the past. Just an educated guess... check with an attorney

Has anyone in Charlotte, NC got a extension on the Driver's license on the basis on the H1-B renewal application receipt.
My spouse's driver's license expires this month end. I have applied for h1-b/h4 renewal, yet to receive the application receipt.But wanted to know if anyone here in Charlotte,NC got a extension/grace (30days or 90days) on the basis of the receipt.

In Dallas I couldnt get based on the receipt. They asked me the I-94. But it was for the H4.

Is it true that my spouse (currently on H4) with pending AOS if outside US when my (principal applicant) approval comes, will not be able to use H4. Will her H4 get invalidated the moment i become a permanent resident. What happens if she boards a plane and reaches US to find that her H4 is not valid ?

I tried it. They might wont ask new approval notice. You should show that and get the expiry date in I-94 as same as your latest I-797 Approval notice.
You don't need to stamp visa as its not expired.....

Our travel doc is expiring in October 2010. My wife would like to travel in Sep and return in Nov/Dec timeframe and now we are waiting since mid July on the renewal. Airfares are already high this year for some reason and we can't make travel plans or book tickets until the last minute. Very frustrating. I remember last year my renewal got approved in less than a month, not sure whats the delay this year...How do we even go about contacting them to expedite?

I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. Responses will be appreciated. Thanks!
She will not have any issues in entering as long as her 485 is pending. Make sure, she gets back before the AP expires.

Hello
I have got done my medical exam required for adjust of status.
My doc gave me only a single sheet of page in a sealed envelop to send to the USCIS for the purpose.
My QUESTION is, is it only one page to be submitted in the sealed envelop, as the form doesnt have any of my passport details or reciept numbers for the form 140's/485
He has only given me page 3 of the attached file, is that sufficient?

I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.
I have 2 questions here.
1) With company A, my LCA was not accurate. My LCA was of NY state & I am working in NJ.
Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.
2) Will there be any issue with my 2 months pay slips (which are of July & Aug). Right now I have submitted my H1 transfer with past 4 months payslips (Sep,Oct, Nov & Dec).
Please advice, I will really appreciate your suggestions on this ASAP.
